Please read these Terms of Service carefully before using the FastAccessMD™ platform. By accessing or using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using the FastAccessMD™ platform at www.fastaccessmd.com (the "Platform"), you agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Platform.

These Terms constitute a legally binding agreement between you and FastAccessMD™. We reserve the right to modify these Terms at any time. Continued use of the Platform after modifications constitutes acceptance of the updated Terms.

2. Description of Service

FastAccessMD™ is a healthcare appointment scheduling platform that connects patients with independent healthcare providers who offer priority, off-schedule appointment slots. FastAccessMD™ is a scheduling facilitation service only.

FastAccessMD™ is not a healthcare provider, medical practice, or licensed medical entity. We do not provide medical advice, diagnosis, treatment, or any clinical services. All clinical decisions and responsibilities remain solely with the licensed healthcare provider you select.

3. Eligibility

You must be at least 18 years of age to use the FastAccessMD™ Platform. By using the Platform, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement.

If you are using the Platform on behalf of another individual (such as a dependent), you represent that you have authority to agree to these Terms on their behalf.

4. Appointment Scheduling

FastAccessMD™ facilitates the scheduling of priority appointments with participating independent healthcare providers. By booking an appointment through our Platform, you understand and agree that:

• FastAccessMD™ appointment slots are separate, off-schedule slots offered by participating providers and do not displace existing patients.
• Appointment availability is subject to change at the discretion of the participating provider.
• FastAccessMD™ does not guarantee that a specific provider will be available at any given time.
• Your appointment is confirmed once payment is processed and you receive a confirmation code.
• The participating provider's office will contact you on the next business day to confirm your appointment details.

5. Fees and Payment

Priority Scheduling Fee: FastAccessMD™ charges a scheduling fee (currently $675) for each priority appointment booking. This fee is a convenience and priority access fee paid directly to FastAccessMD™.

Separate from Medical Fees: The FastAccessMD™ scheduling fee is entirely separate from — and in addition to — any fees, co-pays, deductibles, or charges billed by the healthcare provider's practice for medical services rendered.

Insurance: The FastAccessMD™ scheduling fee is not covered by insurance and will not be submitted to any insurance carrier. Standard billing for your medical visit will be handled separately by your provider's office.

Payment Processing: All payments are processed securely through Stripe. FastAccessMD™ does not store payment card details.

6. Cancellation and Refund Policy

More than 48 hours before appointment: If you cancel your appointment more than 48 hours in advance, you will receive a full refund of the FastAccessMD™ scheduling fee to your original payment method. Please allow 5–10 business days for the refund to appear.

Within 48 hours of appointment: Cancellations made within 48 hours of your scheduled appointment are non-refundable. The full scheduling fee will be forfeited.

No-Shows: If you fail to appear for your scheduled appointment without prior notice, the scheduling fee is non-refundable.

7. User Responsibilities

By using the Platform, you agree to:

• Provide accurate and complete information when registering and booking appointments.
• Arrive on time for your scheduled appointment.
• Bring your insurance card and any required documentation to your appointment.
• Complete any pre-visit intake forms requested by the provider's office.
• Contact us promptly if you need to cancel or reschedule.
• Use the Platform only for lawful purposes.
• Not attempt to circumvent, disable, or interfere with the Platform's security features.

8. Prohibited Uses

You may not use the Platform to:

• Provide false or misleading information.
• Book appointments on behalf of another person without their authorization.
• Engage in fraudulent transactions.
• Scrape, copy, or reproduce Platform content without written permission.
• Attempt to gain unauthorized access to any part of the Platform.
• Use the Platform in any way that violates applicable federal, state, or local laws.

9. Medical Disclaimer

FastAccessMD™ is a scheduling platform only. Nothing on this Platform constitutes medical advice, diagnosis, or treatment. The content provided on the Platform is for informational purposes only.

Healthcare providers accessible through FastAccessMD™ are independent licensed professionals. FastAccessMD™ does not employ, supervise, or control any healthcare provider. FastAccessMD™ makes no representations or warranties regarding the qualifications, expertise, or quality of care provided by any listed provider.

In the event of a medical emergency, call 911 or go to the nearest emergency room immediately.

10. Intellectual Property

All content on the FastAccessMD™ Platform — including text, graphics, logos, images, and software — is the property of FastAccessMD™ and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.

11. Disclaimers of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

FastAccessMD™ does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the Platform.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FASTACCESSMD™ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR SERVICES.

IN NO EVENT SHALL FASTACCESSMD™'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT PAID BY YOU FOR THE SCHEDULING FEE GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless FastAccessMD™ and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

14. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Maine, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Maine.

Before filing any formal legal claim, you agree to contact us at info@fastaccessmd.com and attempt to resolve the dispute informally for at least 30 days.

16. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will post the updated Terms on this page with a new effective date. Your continued use of the Platform following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
